These General Conditions of Sale and Services govern the execution of the sale and services of the company Lansa Design for the Customer. They are concluded between: – Lansa Design, registered with the RCS of Evry under number 529752115, with a capital of €40,000.00, whose head office is located at 12 avenue du Québec – Bâtiment Ibéris – 91140 Villebon sur Yvette Ci- after referred to as “the company”, on the one hand, And – The Customer, consumer, on the other hand, Hereinafter referred to as the “Customer”.

Article 1 – Scope

Les produits mis en vente ne sont pas des jouets et ils doivent être tenus hors de portée des enfants ou en présence d’un adulte. Toutefois, il est possible que certaines variations dans la présentation des produits existent, notamment au niveau des détails décoratifs (emballage, couleurs…). La responsabilité de la société Lansa Design ne saurait être engagée en cas d’usage non approprié par la personne subissant directement ou indirectement le ou les préjudices. Les produits mis en vente sur le site easy-sushi.com sont disponibles. Cependant, si par impossible, une rupture de stocks se produisait sur le ou les articles souhaités, le client serait informé par courrier électronique dans les 3 jours ouvrés maximum qui suivent sa commande du ou des produits indisponibles. La commande initiale du ou des produits indisponibles pourra alors être soit remplacée par la commande d’un équivalent, soit annulée. En cas d’annulation de la commande, le Client percevra le montant total de sa commande initiale dans un délai de 7 jours ouvrés maximum. La société Lansa Design se réserve le droit de modifier à tout moment les prix de ses produits mis en vente sur son site easy-sushi.com.

Article 3 – Characteristics of the purchase service on the easy-sushi.com site with remote payment

Any order placed and confirmed by the Customer entails the conclusion of a distance selling contract between him and the company Lansa Design. Lansa Design reserves the right to accept or refuse any order placed by the customer. In the event of refusal of the order by Lansa Design, the latter will not be required to pay any compensation to the customer. In the event of acceptance of the order by Lansa Design, a confirmation of the order will be sent to the customer, within a maximum of 48 hours, to the email address provided and verified at the time of the said order. In the absence of confirmation of the order by the company Lansa Design within 48 hours maximum, the sale will be deemed void. The total amount paid by the customer will then be fully refunded to him as soon as possible. In case of sending a confirmation of his order by the company Lansa Design, the customer has a period of 14 calendar days, from the day after delivery, to retract. An e-mail will then be sent to the customer confirming his request for withdrawal. In the absence of any receipt of this confirmation letter, no returned product will be reimbursed by Lansa Design. The return of the product must be made under the same conditions as those of the initial shipment. This means that the customer will have to opt for the same carrier, the same transport tracking, the same packaging. The returned product must conform to the one delivered and show no signs of use. Return costs will be borne by the customer. In case of return of a product that does not respect the same conditions as those of the initial shipment, the order will not be refunded. Similarly, in the event of the return of a product showing traces of use, the order will not be refunded. The return must be made no later than 8 working days following our return confirmation, to the following address: Lansa Design – 12 avenue du Québec – Bâtiment Ibéris – 91140 Villebon sur Yvette.

Article 4 – Conditions de règlement

The Customer guarantees to Lansa Design that it holds all the authorizations required to use the chosen means of payment. By indicating his credit card number, the Customer authorizes the site's bank to debit the total amount of the order. All payment information is transmitted to the site's bank. No bank details are collected, stored or processed by Lansa Design. The Customer's bank account, corresponding to the credit card used for payment, will be debited immediately upon placing the order by the Customer. In the event of impossibility of transmitting the flow due by the Customer (opposition, refusal of the bank, etc.), the order and the contract will be automatically cancelled. The company will not be required to carry out any service subsequent to the customer's order if the latter does not pay the price under the conditions and according to the methods indicated in these general conditions of sale and service. services.

Article 5 – Expédition des commandes

Le délai d’expédition varie selon le mode de paiement. La société Lansa Design expédiera la commande dans un délai maximum de 3 jours ouvrés suivant la confirmation de la commande emportant son paiement intégral. L’expédition de la commande ne pourra se faire qu’en France métropolitaine, Dom-Tom et pays limitrophes. Les modes de transport proposés sont les suivants : – Colissimo ou Transporteur ; – Points Relais. Dès l’expédition de la commande, la société Lansa Design communique au client un lien lui permettant de suivre le trajet de son colis, et ce, grâce au numéro de suivi qui lui est transmis lors de l’expédition.

Article 6 – Droit légal de rétractation

Article 7– Livraison

After shipment, the risks weigh on the customer. In the absence of a reservation issued upon receipt, Lansa Design will not be able to process the customer's subsequent complaint, despite the presence of a damaged or destroyed package on delivery. The customer must fill in all the information allowing the compliant delivery of the product. In the event of an error in the delivery address by the customer and the return of the package by the transport provider with the mention NPAI or incomplete address, Lansa Design may reimburse the customer for the amount of the order, excluding the cost of delivery. In this case, the customer must report the lack of delivery to Lansa Design within 25 calendar days from the day the package is taken over by the carrier's services. In the event of an error in the delivery address by Lansa Design, the order will be sent again, under the same conditions as the initial shipment. Delivery costs will then be borne by Lansa Design. If the parcel has not been picked up by the customer at his post office (or Postal Point), the latter is then returned to Lansa Design. Upon receipt of the package, Lansa Design may, at the customer's request, reimburse the entire order, excluding postage. In the event of non-delivery of the package sent beyond 7 working days from the day the order is taken over by the carrier, the customer must contact the carrier. In the event of loss confirmed by the carrier or lack of information, the customer must report the loss to Lansa Design within a maximum of 10 calendar days from the day the package is taken over by the carrier. After this period, no complaint can be processed. Upon receipt of the customer's complaint, Lansa Design will carry out all the necessary checks. If the package has not been delivered, Lansa Design will request the tracking service of the carrier. In the event of final confirmation of the loss of the said parcel by the delivery services, Lansa Design will reimburse the order, subject to the communication by the customer of a sworn statement stating that he has not received the parcel. The delivery times indicated apply from the day the parcel is taken over by the carrier. Delivery times are communicated in good faith and for information only. Non-observance of delivery times shall not result in the cancellation of the order or any compensation whatsoever. No package is sent abroad (outside neighboring countries).

Article 8 – Garanties légales

Under the terms of Articles L.211-4 of the Consumer Code and 1641 of the Civil Code, the customer benefits from the legal guarantees of conformity and hidden defects for orders placed on the Lansa Design e-commerce site. The customer has a period of two years to act from the delivery of the product. According to article L. 211-9 of the consumer code, in the event of a lack of conformity, the customer chooses between the repair and the replacement of the goods. The customer can implement the guarantee due to hidden defects of the thing sold provided for by article 1641 of the civil code. In the event of a hidden defect, the customer chooses between the resolution of the sale or a reduction in the sale price. In the event of implementation of the legal guarantees, the disputed products must be sent in perfect and complete condition (accessories, packaging, instructions, etc.). Shipping costs will be reimbursed on the basis of the invoiced rate and return costs will be reimbursed on presentation of receipts. Reimbursement of disputed products will be made after careful examination of the latter. Any warranty is excluded in the following cases: – abnormal use or mishandling; - neglect ; - abuse ; – lack of maintenance; – poor storage conditions; – normal wear and tear; – force majeure; – use that does not comply with the Supplier/Manufacturer's specifications; – commercial or collective use; – repair or modification carried out by a third party not approved by the Supplier/Manufacturer.

Article 9 – Responsabilités

Article 11 – Données à caractère personnel

They are not intended to be sold, shared or communicated to third parties for commercial or prospecting purposes. Lansa Design only keeps data for the duration necessary for the operations for which it was collected and in compliance with the regulations in force. In this respect, Customer data is kept for the duration of the contractual relationship plus 5 years, without prejudice to retention obligations or limitation periods. In terms of accounting, the data is kept for 10 years from the end of the accounting year. Lansa Design, whose head office is located at 12 avenue du Québec – Bâtiment Ibéris – 91140 Villebon sur Yvette, represented by Lansa Design, is responsible for processing said data. Personal data may be stored and processed in any European Union country subject to GDPR No. 2016/679. The Customer has a right vis-à-vis the data controller to access personal data, access to data concerning him, rectification, interrogation, limitation, portability, deletion, or the right to oppose the processing of data, as well as the right to lodge a complaint with a supervisory authority. It is specified that the Customer must be able to prove his identity, either by scanning an identity document, or by sending Lansa Design a photocopy of his identity document.

Article 12 – Propriété intellectuelle

The Customer is prohibited from any reproduction or exploitation of the products offered for sale, without the express, written and prior authorization of the company Lansa Design, under penalty of legal proceedings. Lansa Design remains the owner of all intellectual property rights to the brands, logos, slogans, graphics, photographs, animations, videos and texts contained on the site. Any total or partial representation of the site and its content, by any process whatsoever, without the express prior authorization of the company Lansa Design, is prohibited and constitutes an infringement punishable by articles L. 335-2 and following and articles L. 713-1 and following of the intellectual property code.

Article 13 – Litiges

Any dispute arising from the execution, interpretation or termination of the contract will be settled according to the rules specifically applicable in the matter. These general conditions of sale and provision of services and the resulting purchase and sale transactions are governed by French law. In accordance with the provisions of articles L. 612-1 and following of the consumer code, the Customer has the possibility as a consumer, to send complaints to the company Lansa Design by electronic message or by mail to the address of the head office. social. In the event of a dispute, the competent jurisdictions are those of the place where the registered office of the company Lansa Design is established. These general conditions of sale and provision of services are expressly approved and accepted by the Customer, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely on any contradictory document and, in particular, his own general conditions of purchase, which will be unenforceable against Lansa Design, even if it has knowledge of them.
